It is illegal for a mortgage servicer, a creditor, or a debt collector to threaten or harass you. It is illegal for them to discuss your debt with friends or family members. It is illegal for them to attempt to collect debts that are not owed.

When any of these actions (and certain others) are taken, it is against the law, and a lawsuit can be filed against the offender. If this has happened to you, the most important thing you can do is to keep good records (and don’t ever erase a threatening call that is left as a message, this is evidence):

Who did you speak with?
What company do they represent?
What was the date of the call?
What was said?
How did the call make you feel?

Without good records, you have a weaker case. With good records you may be able to stop the same harassment from happening to others, and your Attorney may be able to get you a money award. In an age of growing discourtesy, disrespect for the rights of others, and collection greed, there is a good chance that sooner or later someone will contact you about a debt of yours, or a debt of someone else. There is something you can do about it.
